Abstract

INDONESIA : Pemikiran Isnawi dalam Kawkab ad-duri fi Takhrijil Furu’ al-Fiqihiyyah ala al-Masaail al-Nahwiyyah menjadi urgen untuk dikaji para faqih dan sarjana Islam karena metodologi istimbath yang digunakannya adalah dengan pendekatan yang berbeda karena lebih mengutamakan satu kajian linguistik, melalui instrumen kaidah Nahwu dan perspektif ulamanya serta keterkaitannya dengan kajian-kajian bahasa dalam Ushul Fiqih. Penelitian ini bertujuan untuk menganalisis sejauh mana kaidah Nahwu berpengaruh pada Ushul Fiqh. Memahami langkah-langkah kontribusi teori Isnawi dalam metodologi Takhrij furu melalui Ilmu Nahwu dan pengaruhnya terhadap Ushul Fiqh. Serta menjelaskan hubungan ilmu bahasa (Nahwu) dan Syariah Islam. Penelitian ini menggunakan metode kajian kepustakaan (liberary research) yang termasuk dalam kategori penelitian historis tekstual mengenai konten naskah kitab. Sumber penelitian melalui data primer, sekunder, dan tertier yang diperoleh dari literatur, dokumentasi, dan pendapat para ahli. Kerangka teori utama yang bersifat universal ( grand theory), dalam penelitian ini karena yang diteliti masalah filsafat hukum maka teori yang digunakan adalah teori hukum alam, kedua, teori penengah (middle theory) karena fokus penelitian adalah sumber dan istimbath hukum (melalui teori Takhrijul furu’) maka teori yang digunakan adalah hirarki hukum Islam dan stufenbau. Ketiga, teori aplikatif dalam hal ini yang digunakan adalah teori Takhrij furu’ ala masailil an-nahwiyyah Imam Isnawi. Hasil penelitian ini: Pertama, kontribusinya menjadikan instrumen untuk mengaplikasikan kaidah Nahwu sebagai salah satu Ushul istimbath kajian bahasa Ushul Fiqh dari sebuah teori menjadi sebuah hukum fiqih yang aplikatif. Kedua pemahaman kaidah Nahwu sangat berperan dalam menentukan pemahaman nas-nas Syariah yang benar dan sesuai dengan apa yang diinginkan Allah Swt, karenanya orang yang tidak memahami Nahwu dilarang untuk memberi Fatwa. Ketiga Konsep Isnawi dalam membuat kesimpulan Takhrijul Furu’ alal Masail al-Nahwi tidak selalu mengikuti pendapat yang mu’tamad dari madzhab Syafi’i, seperti dalam masalah kembalinya dlomir kepada Mudlof dan bukan mudlof ilaih dalam ayat yang menjelaskan najisnya babi. Isnawi mengatakan bahwa yang najis hanyalah dagingnya saja sesuai dengan kaidah mudlof dan mudlof ilaih dan fiqih madzhab Maliki . Keempat, metode istimbath takhrij furu’ ala masail an- nahwiyyah ini belum banyak dikaji, hingga perlu adanya maadah khusus agar menjadi sebuah bidang studi dikalangan pesantren dan akedemisi hukum Islam. ENGLISH : Isnawi thinking in Kawkab ad-duri fi Takhrijil Furu 'al-Fiqihiyyah ala al-Masaail al-Nahwiyyah becomes urgent to be studied by the faqih and Islamic scholars because the istimbath methodology used is a different approach because it prioritizes one linguistic study, through the Nahwu instrument and the perspective of the ulema and its relation to language studies in the Ushul Fiqh. This study aims to analyze the extent to which Nahwu's Rules knowledge influences the Ushul Fiqh. Understand the steps in applying the Isnawi theory in the Takhrij furu methodology through the Nahwu Science and its influence on the Ushul Fiqh. As well as explaining the relationship of linguistics (Nahwu) and Islamic Sharia. This research is a literature study (liberary research) which is included in the category of historical textual research on the content of textbooks. Sources of research through primary, secondary, and tertiary data obtained from the literature, documentation, and opinions of experts. The main theoretical framework that is universal (grand theory), in this study because those who examined the problem of legal philosophy then the theory used is natural law theory, second, middle theory, because the focus of research is the source and istimbath law (through the theory of Takhrijul furu ') then the theory used is the Islamic law hierarchy and stufenbau. Third, the applied theory in this case that is used is the theory of Takhrij Furu 'ala Masailil an-nahwiyyah Imam Isnawi. The results of this study: First, its contribution made the instrument for applying Nahwu Rules as one of the Ushul istimbath studies of the Ushul Fiqh from a theory to being an applicable law of jurisprudence. Second, the science of nahwu is very instrumental in determining the understanding of the Shariah texts that are true and in accordance with what God wants, therefore people who do not understand Nahwu are prohibited from giving Fatwa. Third, Isnawi Concepts in making the conclusions of Takhrijul Furu 'alal Masail al-Nahwi do not always follow the opinion of the one from the Shafi'i schools, as in the problem of returning to Mudlof and not the mudlof ilaih in the verse explaining the unclean pig. Isnawi said that only the unclean flesh is in accordance with the principles of the morality of the Mudlof ilaih Nahwu and the Maliki schools of fiqh. Fourth, the istimbath takhrij furu 'method, which is very much annotated, has not been widely studied, so that it needs to be prepared specifically to become a field of study among Islamic boarding schools and Islamic law academic. ARAB : إن أفكار العالم الجليل جمال الدين الإسنوي التي تتبلور في كتابه المسمى بالكوكب الدري في تخريج الفروع الفقهية على المسائل النحوية، ذات أهمية لمحل الدراسة والنظر لدى كل فقيه وباحث. لأنه كان يفضل في نهج استنباطه للأحكام الفقهية، أولوية البحث في المسائل اللغوية أولا، وبالنظر إلى المباحث النحوية ووجهات نظر علماء اللغة والأصول الغفقه . رغم أن المناهج في استنباط الأحكام تكون دراستها من وجهة نظر أصول الفقه في أغلبها. تهدف هذه الأطروحة إلى تحليل مدى تأثر علم أصول الفقه بقواعد النحو ودوره في استخراج الفروع من الأحكام الفقهية. ولأجل الحصول على الإلمام والفهم حول الخطوات لتطبيق نظرية الشيخ جمال الدين الإسنوي في منهجه لتخريج الفروع، عن طريق علم النحو، وأثره في أصول الفقه طبقا لمذاهب الفقهاء, أيضا لبيان مدى تأثير علم النحو في فهم الاختلافات بين مذاهبهم. تتصف هذه الأطروحة لكونها من الدراسة المكتبية التي يشملها نوع الدراسة النصية التاريخية لمضمون نص الكتاب. ويتكون مصدر البحث في هذه الأطروحة من المصادر الأساسية والتبعية، التي تشمل الكتب والأرشيفات وأراء الخبراء. ويكون الإطار النظري لهذه الأطروحة، أولا من جهة عامة، أن مجال البحث فيها من مسائل فلسفة تشريع الأحكام. لذا، اعتمد الباحث على استخدام نظرية الحكم الطبيعي. وثانيا؛ من جهة النظر الواسطي؛ بالنظر إلى أن ركائز هذه الأطروحة هي مصادر الأحكام واستنباطها من خلال استخدام فن تخريج الفروع، فيكون المنهج المستخدم هي منهج التاريخ التشريع وتطوره. وثالثا؛ نظرية التطبيق. وفي هذا الجانب، اعتمد الباحث على استخدام منهج الإمام جمال الدين الإسنوي في تخريج الفروع على المسائل النحوية. والخلاصة، أن لهذه الأطروحة نتائج. أولا؛ تكون نوعا من المساهمة الفكرية لتطبيق قواعد النحو، من مرحلة النظرية الأصولية كإساس استنباط الحكم إلى تحقيق الفروع الفقهية بشكل عملي. ثانيا؛ تتيح المنافع لوجود التعلق بين علم اللغة خصوصا النحو والشريعة الإسسلامية لمعرفة نص الشريعة الصحيحة بما أراد الله به. ثالثا؛ تبين أن منهاج الأسنوي في تخريج الفروع على المسائل النحو في بعض الأحيان لم يوافق بما إعتمد به مذهب الشافعي كما وقع في تحرير حكم نجاسة الخنزير , فإن الأسنوي يذهب بما ذهب به المالكية في أن جلد الخنزير طاهر. و قال الأصح أن عود الضمير في الأية تدل إلى المضاف لا المضاف إليه كما اعتمد وحقق به النحوييون في قاعدته. رابعا أن منهاج تخريج الفروع لم يكثر فيه الإهتمام والبحث من قبل الباحثين والناظرين, لذا يجدر العناية بدراسته في المعاهد الإسلامية والهيأت التعلمية الأخرى, بين الطلاب والأكادميين في مجال الشريعة اللإسلامية
