Abstract

INDONESIA : Dalam Pasal 18 ayat (4) UUD 1945 dinyatakan bahwa “Gubernur, Bupati dan Walikota masing-masing sebagai kepala pemerintahan provinsi, kabupaten, dan kota dipilih secara demokratis”. Secara legal formal landasan pilkada tersebut membuka peluang calon perseorangan dalam pentas politik lokal. Di satu sisi hal tersebut memberikan suatu harapan demi terwujudnya pilkada demokratis dengan memaksimalkan peran calon perseorangan. Namun pada sisi lain menunjukkan bahwa keikutsertaan calon perseorangan dalam pilkada yang notabenenya telah dijamin oleh konstitusi, dalam kenyataannya minim peran. Misalnya dari keseluruhan jumlah wilayah penyelenggara pilkada 2017 sebanyak 101 daerah, hanya 3 kepala daerah dari jalur perseorangan terpilih di tingkat wilayah administrasi kabupaten (Pidie, Boalemo, dan Sarmi). Tentu saja ini dikhawatirkan mengurangi makna substantif terbukanya kesempatan bagi calon perseorangan. Dengan melihat permasalahan yang ada, tujuan penelitian ini meliputi pertama; untuk menganalisis kajian kritis persyaratan pencalonan kepala daerah jalur perseorangan, dan kedua; untuk menguraikan rekonstruksi hukum terhadap persyaratan pencalonan kepala daerah jalur perseorangan agar tercapai pilkada demokratis. Adapun metode yang digunakan dalam penelitian ini adalah normatif empiris yang bersifat descriptive research. Sumber data yang digunakan dalam penelitian ini adalah sumber data primer dan sekunder. Teknik pengumpulan data dilakukan dengan cara studi kepustakaan. Data-data yang diperoleh kemudian dianalisis secara kualitatif dengan pendekatan deskriptif kualitatif. Teori yang digunakan dalam penelitian ini adalah teori konstitusi sebagai grand theory. Selanjutnya untuk melihat sistem yang diberlakukan secara konstitusional dalam penyelenggaraan pilkada, digunakan teori demokrasi sebagai middle theory dan untuk meneliti tentang prinsip dasar peran calon perseorangan dalam kontestasi pilkada digunakan teori hak asasi manusia sebagai pisau analisis/applied theory. Berdasarkan penelitian yang dilakukan dapat diketahui hasil penelitian yang menyimpulkan bahwa pertama; terbukanya calon perseorangan menimbulkan beberapa kajian kritis diantaranya perbandingan syarat dukungan minimal bagi calon perseorangan dinilai lebih besar dan berat dibandingkan dari calon jalur parpol/gabungan parpol. Selain itu, calon perseorangan tidak memiliki mobilisasi politik sehingga menghambat akses jaringan massa (pemilih) yang kuat. Besarnya biaya administrasi dan operasional bagi calon perseorangan juga menjadi fokus problematika selama ini. Kedua; syarat calon perseorangan sesuai Pasal 41 Ayat (1) dan (2) Undang-Undang Nomor 10 Tahun 2016 perlu diupayakan suatu rekonstruksi hukum dengan dilakukannya pengkajian ulang mengenai acuan dan presentase syarat dukungan minimal bagi calon perseorangan, selanjutnya menjadi pertimbangan untuk dilakukan revisi materi muatannya. Pasal 18 ayat (4) UUD 1945 sebagai landasan pilkada maka rekonstruksi hukum tersebut diarahkan pada penerapan persamaan kedudukan dan kesempatan yang sama. Sehingga keputusan politik untuk menyelenggarakan pilkada dengan meningkatkan peran calon lewat jalur diluar partai politik akan menjadi langkah strategis dalam rangka memperluas, memperdalam, dan meningkatkan kualitas demokrasi. ENGLISH : As in Article 18 paragraph (4) it is stated that “Governors, Regents and Mayors respectively as heads of provincial, district and municipal governments are elected democratically”. On this basis which legally formal open opportunities for independent candidates in the local political stage. On the one side it provides a hope for the realization of democratic elections by maximizing the role of independent candidates. But in other side, the facts show that the participation of independent candidates in the election has already guaranteed by the constitution, but in reality faced minim participate. For example, from the total number of 2017 regional electoral districts of 101 districts, only 3 regional heads from selected independent areas at the district administrative level (Pidie, Boalemo, and Sarmi). Of course this is feared to reduce the substantive meaning of open opportunities for independent candidates. By looking at the existing problems, the research objectives include first; To analyze a critical review of independent candidates, and second; To outline the legal reconstruction of the requirements of the nomination of the head of the independent tracking in order to achieve democratic elections. The method used in this research is the empirical normative descriptive research. Source of data used in this research is primary and secondary data source. Technique of collecting data is done by library study. The data obtained then analyzed qualitatively with qualitative descriptive approach. The theory used in this research is the theory of constitution as a grand theory. Furthermore, to see the constitutionally enforced system in the implementation of elections, used the theory of democracy as the middle theory and to examine the basic principles of the role of individual candidates in the contest election of regional head used the theory of human rights as a applied theory. Based on the research conducted can be known the results of research that concluded that the first; The opening of individual candidates raises some critical issues such as the comparison of minimum support requirements for individual candidates is considered bigger and heavier than the candidate of political parties / political parties. In addition, individual candidates do not have political mobilization thereby hampering strong access to mass networks (voters). The amount of administrative and operational costs for individual candidates is also the focus of the problematic so far. Second; The requirements of independent candidates pursuant to Article 41 Paragraph (1) and (2) of Law Number 10/2016 need to be pursued a legal reconstruction with a review of reference and percentage of minimum support requirements for individual candidates, then consideration for revision of material. Article 18 Paragraph (4) of the UUD 1945 as the basis for the Regional Head Election, the reconstruction of the law is directed to the application of equal status and the opportunity. So the political decision to organize the elections by increasing the role of candidates through out-of-the-line political parties will be a strategic step in expanding, deepening, and enhancing the quality of democracy.
