Abstract

INDONESIA : Pengawasan dalam Pemilihan Kepala Daerah serentak tahun 2017 di Jawa Barat diikuti oleh Kota Cimahi, Kabupaten Bekasi dan Kota Tasikmalaya, Badan Pengawas Pemilu mempunya tugas dan wewenang sesuai Pasal 28 Undang-Undang Nomor 10 Tahun 2016 Tentang Penyelenggaraan Pemilihan Gubernur, Bupati dan Walikota, dimulai dari pengawasan dan sinkronisasi Daftar Pemilih Tetap (DPT), kecurangan pada masa kampanye dan dana kampanye, pelaksanaan perhitungan suara sampai kepada gugatan sengketa sehingga tidak sesuai dengan prinsip-prinsip demokrasi itu sendiri. Permasalahan yang diteliti dalam penelitian ini adalah, bagaimana pelaksanaan pengawasan Pemilihan Kepala Daerah serentak tahun 2017, apa yang menjadi kendala dalam Pemilihan Kepala Daerah serentak tahun 2017 serta tentunya konsep apa yang ditawarkan oleh penulis guna perbaikan pemilihan umum kedepan. Tujuannya sudah barang tentu agar perhelatan demokrasi di Negara Kesatuan Republik Indonesia menjadi semakin baik dari sebelumnya. Penelitian ini merupakan tipe penelitian deskriptif analitis dengan pendekatan yuridis empiris mengenai bagaiamana pelaksanaan pengawasan pemilihan Pemilihan Kepala Daerah/Wakil Kepala Daerah (Pemilihan Kepala Daerah) serentak Tahun 2017 di Provinsi Jawa Barat di Kota Cimahi, Kabupaten Bekasi dan Kota Tasikmalaya. Penelitian ini termasuk kategori kualitatif dan sebagai metode penelitiannya adalah studi kasus berupa pelanggaran (administrasi, kode etik dan pidana). Hasil penelitian ini penulis diketahui bahwa dalam pengawasan penyelenggaraan pilkada serentak tahun 2017, diantaranya sebagai berikut: 1). Badan Pengawas Pemilu Provinsi Jawa Barat membentuk Panwaslu Kabupaten/Kota, yang nantinya dibentuk sampai ketingkat Pengawas TPS, melaksanakan pengawasan tahapan penyelanggaraan pilkada serentak 2017 2.) Kendala yang dihadapi dalam pilkada serentak 2017 dibagi dalam kendala internal (kualitas pengawas pemilu dan terlalu singkat waktu dalam pelaksanaan bimbingan teknis) dalam kendala external (letak geografis tiap daerah yang berbeda dan ketidakpatuhan para peserta pilkada serentak 2017 3.) Konsep yang ditawarkan dengan sesuai dengan prinsip-prinsip demokrasi diantaranya Negara Berdasar Konstitusi, Jaminan Hak Asasi Manusia, Kebebasan Pers, Hak-hak Minoritas dan Adanya Peradilan Bebas dan ENGLISH : Supervision in the Regional Head Election simultaneously in 2017 in West Java followed by the City of Cimahi, Bekasi and Tasikmalaya, the Election Supervisory Board has the duty and authority in accordance with Article 28 of Law Number 10 Year 2016 concerning the Governor, Regent and Mayor Elections, starting from supervision and synchronization of the Permanent Voter List (DPT), campaign fraud and campaign finance, vote counting to dispute lawsuits so as not to comply with the democratic principles themselves. The problems studied in this research is, how the implementation of supervision of Regional Head Election simultaneously in 2017, what is a constraint in the Regional Head Election simultaneously in 2017 and of course the concept of what is offered by the author to improve the general election forward. The goal is certainly for the democratic event in the Unitary State of the Republic of Indonesia to be better than ever. This research is a type of analytical descriptive research with empirical juridical approach on how the implementation of supervision of election of Regional Head / Deputy Regional Head (Election of Regional Head) simultaneously in 2017 in West Java Province in Cimahi City, Bekasi Regency and Tasikmalaya City. This research belongs to qualitative category and as research method is case study in the form of violation (administration, code of ethics and criminal). The results of this study the author is known that in the supervision of the implementation of elections simultaneously in 2017, including as follows: 1). The West Java Election Supervisory Board establishes the Regency / Municipal Panwaslu, which will be established until the level of the TPS Supervisor, conducts supervisory stages of the electoral election simultaneously 2017 2.) The constraints faced in 2017 simultaneous elections are divided into internal constraints (the quality of election supervisors and too short a time in implementation of technical guidance) in external constraints (geographical location of each different region and non-compliance of electoral participants 2017 simultaneously 3.) Concepts offered in accordance with democratic principles such as Constitution-based State, Human Rights Guarantees, Freedom of the Press, Rights Minority and the existence of Free and impartial Judiciary.
